The Firearms Act 1973 and Firearms Regulations 1974 enables the WA Police Force to issue an infringement as an alternative option to deal with Firearms offences.

The period for which this section provides that a licence is valid is subject to:

under which the licence ceases to be valid earlier.
An Ammunition Collectors Licence is valid for a period of 5 years from the day on which it was issued or last renewed.
Any other licence under this Act is valid for a period of 12 months from the day on which it was issued or last renewed.
The Commissioner may, on payment of the prescribed fee, renew a licence from time to time for further periods on application made within one month before, or within 12 months after, its expiry.
A renewed firearms licence takes effect from the expiry date stated on the licence regardless of when payment was received. A licence cannot be renewed under this section more than 12 months after its expiry, but the person who held it is not prevented from making an application for a licence under section 18(1).
Pay Renewal


A Firearms Infringement Notice is issued to an individual person.
If you do not want to be prosecuted in court for the alleged offence, pay the Amount Due by the Due Date AND pay your Firearms Licence. If no payment is received by the Payment Due Date, WA Police Force may commence prosecution proceedings against you.
Please note: If payment is not received you will not be issued a Final Demand Notice, nor will the matter be referred to the Fines Enforcement Registry. Either the Infringement is paid, or the matter is taken to court. 
Paying the penalty amount will not constitute a conviction of an offence under the Act and will not be regarded as an admission of liability for or affect any civil court case.
The range of payment options are listed on the Infringement Notice and your Firearms Licence notice. Alternatively, if you want this matter dealt with by prosecution in court then do NOT pay the Infringement and WA Police Force may commence prosecution proceedings.

Please note: Your firearms licence has eight (8) digits. If you have an existing firearms licence with seven (7) digits, please include a zero (0) at the start of the licence number.

You may also pay in person at police stations with facilities to receive payment and only where there is no local Australia Post. 
Infringements are generated three months after expiry of your firearm licence. Once an Infringement has been generated, the only way to renew your firearm licence is to attend the nearest police station within office hours and have the renewal invoice and infringement served.

Once an infringement has been generated, your firearms are subject to seizure by police as they are unlicensed – and have been for three months.

Please note: Renewals are issued and mailed 28 days prior to expiry of licence. 
 
The licence held by you is expired.
After 3 months an infringement is issued and the offence is possession of any unlicensed firearm or ammunition.
As a result it may be alleged you are contravening the Act. 
Firearms Act 1973 section: 19(1)(c)

Under Section 19 (1) Firearms Act 1973 it is an offence to be in possession of unlicensed firearms:


It is an offence to be in possession of a firearm if the licence has expired. It is the responsibility of the firearm licence holder to ensure their firearm licence remains current.
Where a firearm licence holder’s licence has expired by 3 months or more, an infringement notice will be personally issued by Police to the licence holder.
The licence holder firearm(s) will be seized at the time the infringement is served if the renewal has not been paid.
A renewal notice will be provided at the time the infringement is served and the licence holder must renew the licence and pay the infringement prior to any firearms being returned by police.
If the infringement notice is not paid within 28 days the licence holder may be charged with an offence under Section 19 (1) Firearms Act 1973.
Should the licence holder not wish to renew their licence, they may legally dispose of, or have their firearm(s) destroyed by completing a P94 form – Authority to Dispose by police.
